Important information about your use of ApplyAway software
Terms and Conditions

ApplyAway may offer additional features and services (the "Services" or individually a "Service") to you in connection with your use of the ApplyAway Immigration Services Software (referred to as "Software"). Additional fees may apply, and the Services will be subject to the additional terms and conditions set out below (subject to amendment from time to time at ApplyAway's discretion).
IMPORTANT NOTES:
It is your sole responsibility to keep all records in support of your application, including receipts and other documents. ApplyAway assumes no obligations to store your documents other than as may be required by law and business needs (see "Storage/Deletion of Your Client File" below). By purchasing or using our Software or Services you are accepting the respective terms and conditions applicable to it, and your use of the Software or Services is conditional on that acceptance. If you do not agree to the terms and conditions, then you may choose not to use the Software or Services.
These terms are to be read in conjunction with our Policies, our Site Terms and Conditions, and our Online Services and Retainer Agreement.
PRODUCTS AND SERVICES
ApplyAway's Immigration Software makes immigration and visa applications easy by providing an automated and dynamic guidance platform to take you through each step of the process.
It's simple: 1) make an account; 2) choose an application type; 3) add family members if applicable; 4) Apply Away!
1. Temporary Residency Permit and Visa Applications

3. AskAway Help Services
Free email help for applicants with a registered account. Note: please allow up to two (2) business days for responses. Priority will be on a first-come, first-served basis.
Exclusions:
- Questions regarding types of applications other than your selected application.
- Questions not clearly related to either immigration or to any technical concerns regarding the Products and Services.
- Questions regarding the procedures involved in reviewing your application.
- Questions regarding any details of the immigration process outside of filling and submitting an application.
STORAGE/DELETION OF YOUR CLIENT FILE
In accordance with the Client File Management Regulations of the Immigration Consultants of Canada Regulatory Council (ICCRC), section 7.2, ApplyAway is obligated to retain your information in a secure location for a minimum of six (6) years after the File has been closed. After six (6) years your application data will be destroyed. Pursuant to section 7.2, when destroying a Client File, ApplyAway shall ensure that the Client's confidentiality is maintained.
ApplyAway shall maintain a record of destroyed files, including at minimum:
- The Client's name and address;
- A brief description of the service provided;
- The File Closing Date; and
- The Actual File Destruction Date.

HELP AND SUPPORT
ApplyAway may use a variety of Support Services (e.g., in-product help, email, chat, etc.), to provide technical support and customer service in connection with the Software. The terms and conditions governing the offering of this Service, which may require the payment of an additional fee, and may be subject to change without notice, will be updated when necessary here and on our Pricing page.
WARRANTIES
All warranties or guarantees given or made by ApplyAway with respect to any Software or Service (1) are for the benefit of the original user of the Software or Service only and are not transferable, and (2) shall be null and void if the user breaches any terms or conditions of this Agreement.
LIMITATION OF LIABILITY AND DAMAGES
Any advice provided to you by an ApplyAway representative is based solely on information you provide in your application, at your sole responsibility, including answers you gave in correspondence. You understand and agree that the representative is not able to verify the information you provide, and that if you provide incorrect or incomplete information, the advice provided to you may not be accurate.
You have sole responsibility for reviewing your application(s) and uploaded documentation, and confirming their overall accuracy and completeness prior to submitting to the IRCC. You agree not to hold ApplyAway liable for any loss or damage incurred as a result of your use of the Software or Service. Additionally, except for the reimbursement for inaccuracy expressly set out in this Agreement, ApplyAway assumes no liability whatsoever related to the Software or Service.
100% ACCURACY GUARANTEE
ApplyAway warrants the ApplyAway Software's accuracy for your immigration application based solely on the information provided by you. If your application is rejected solely as a result of a preparation error on a form prepared using the ApplyAway Software, and not as a result of, among other things:
- your failure to provide all required information accurately or your misuse of the ApplyAway Software,
- your negligent, willful, or fraudulent omission of pertinent information or inclusion of inaccurate information on your application file, or
- your misclassification of information on your application,
then ApplyAway will refund you all application fees.
